WAIVERS: UK Flag – Jersey

1) The College has a formal union with the Jersey Branch of UNISON. In line with the settlement agreement which ended the dispute concerning the education reforms announced in July, the College and UNISON agree that this is the College’s Official Trade Union (OTU).

A copy of the settlement agreement is available in the College’s Services Department.2) As specified in paragraphs 14.2, 14.4 and 14.6 of the Development Policy, there is no requirement for the College to staff a UK trade union department or have a UK trade union branch.3) The College’s position that this is an unofficial union is not supported by the Collective Agreement between the College and the University Union (which effectively corresponds to the HEFA for the University, and of which UNISON is a branch).4) UNISON has been informed that the College is not accepting that the union has any status in relation to contract negotiations.

On 18 October 2007 I wrote to Mark Sugden (Mathematics Tutor) regarding your position with UNISON and the College. I thank you for your response on your behalf to my correspondence of 7 December.

In your reply of 7 December, you confirmed that “there was no intention on the part of either side to interpret the exchange as a waiver.”

The College is extremely concerned that UNISON might interpret the exchange as a waiver. This would, of course, be most unfortunate from our perspective. The College does not wish to be accused of making any admissions or concessions which could compromise its claim to be represented by a duly recognised UK Trade Union.

If the College is found to have waived its right to be represented by a UK Trade Union, the College will be in breach of its obligation under section 9.2 of the Development Policy of the College to consider the views
